COVID-19 - NEW CDC DECLARATION ATTESTATION FORM - AO 229 LANDLORD CERTIFCATION
Effective January 1, 2021 landlords must include additional information in their eviction complaint for non-payment of rent. We have prepared a form for all clients to submit with each eviction requested. We will require confirmation that you have not received a CDC declaration from your tenant as well as a confirmation whether or not you have applied for rental assistance and, if so, if you have both received it and applied the assistance to the tenant ledger. Also, if your records reflect you previously obtained an inciting judgment against your tenant we are required to include that disclosure in the complaint.
Attached to this communication is the form we have prepared to cover all of these additional disclosures. We ask that you have this submitted with each tenant you seek to file on for non-payment of rent. For those cases that you have already submitted to our office which have not been assigned a court date we would request that you submit this form for those pending matters. Our team will be reaching out on all cases that do not have the required form as the matter cannot proceed to filing without this information.
