COVID-19: EVICTION PROTOCOL UPDATE

On March 27, 2020, President Trump signed House Bill 748 known as the CARES Act. The CARES Act provides, for some communities, a prohibition on the filing of evictions for 120 days from March 27, 2020 for nonpayment of rent.
What does this mean for your community?
1. Landlord’s ability to commence eviction actions for material health and safety violations, material non-compliances, and material and irreparable breaches remains unchanged.
2. Tenants are not excused from performing their obligations under the lease.
3. Tenants are not excused from paying monthly rent.
4. Communities with federally backed mortgages or those subject to VAWA (i.e. Section 8 Voucher, Section 8 Project Based, LIHTC, etc.) cannot file an eviction for non-payment of rent until August 2020.
5. Communities with federally backed mortgages or those subject to VAWA (i.e. Section 8 Voucher, Section 8 Project Based, LIHTC, etc.) cannot issue a non-renewal notice until August 2020.
